Masters and Instructors
If you are a divemaster
or instructor, it is critical that you obtain liability insurance
to cover you for any lawsuits or claims arising out of your divemaster
or instructor activities. Typically, such insurance policies
not only require the insurance company to compensate the injured
party, but also require the insurance company to pay your legal
expenses of defending the case against you. Without such insurance,
your personal assets are in serious jeopardy in the event of an
accident. Additionally, most liability insurance policies require
that the divemaster or instructor abide by the training agency rules
and regulations including the proper execution of releases and student
training recordkeeping requirements. Frequently,
the insurance companies will assert training deficiencies, recordkeeping
deficiencies, and improper release protocols as an excuse not to
cover serious diving accidents. Accordingly, not only must the divemaster
and instructor abide by proper training protocols, careful attention
must be devoted to proper student training documentation and release
of liability forms. Above all, if a diving accident occurs, promptly
notify your insurance carrier.
